Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the website and participating in any services offered by The Pelvister (“Company”, “we”, “us”, or “our”). By accessing or using our website and services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our website or services.
- Scope of Services
You understand that although our program instructors may be physical therapists, our virtual exercise programs, whether offered to the public for free or through a paid program, are designed to promote pelvic health and general wellness. These classes, even if targeted at a specific medical or physical problem, are educational in nature and are not intended to diagnose, treat, cure, or prevent any medical condition. If we suggest self-assessment procedures, it is not intended to substitute for a medical or physical therapy exam. If we answer questions from you or other participants in the group, our answers are intended to be hypothetical only and not intended as specific medical or physical therapy advice for you or any other individual.
You acknowledge and agree that we have not examined you (and have no duty to examine you), hence participation in our classes does not establish a provider-patient relationship or constitute physical therapy services under any state or federal laws. We do not claim that our general exercise/fitness, wellness and general coaching program(s) will result in any particular or specific therapeutic, performance or other outcome.
- Licensure Disclaimer
Our instructor is a licensed physical therapist in the state of Kentucky. However, the classes offered are general wellness and fitness sessions and are not state-specific medical advice or treatment. As no individualized assessments or treatments are provided, licensure limitations do not apply to participants located outside of Kentucky.
- Health and Safety Disclaimer
By participating in any exercise classes, programs, or using instructional content provided by The Pelvister, you acknowledge and voluntarily accept that physical exercise carries inherent risks. These risks may include, but are not limited to:
- Muscle strains and tendinitis
- Back, neck, or joint injuries
- Cardiovascular events (including but not limited to heart attack or stroke)
- Loss of balance, resulting in falls or bone fractures
- Muscle soreness from engaging weak or deconditioned muscle groups
- Severe outcomes such as paralysis or, in extremely rare cases, death
If a class or exercise involves balance work or use of props (e.g., resistance bands, weights, or therapy/stability balls), you understand that improper use or equipment malfunction may increase the risk of injury.
You are responsible for using your best judgment, participating within your physical limits, and consulting and obtaining clearance with a physician or licensed healthcare provider before participating in our exercise program, particularly if you have any pre-existing conditions such as pelvic pain, incontinence, or other pelvic floor dysfunctions. Your participation in our online program is solely at your own risk whether you obtain medical clearance or not. You knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for your participation.
By using our services, you voluntarily assume any and all risks, known and unknown, associated with your participation in these classes and waive any claim against The Pelvister and its instructors for any injury or harm that may result.
- Group Session Privacy and Recordings
By participating in any online group session offered by The Pelvister, you acknowledge and agree that you have no expectation of privacy during the session. Group classes are conducted in an open virtual environment where other participants may see or hear you, and you are advised not to share any personal health information or details you wish to remain private.
If you participate in an individual online instructional or educational session, you understand and agree that it is not a telehealth session. Because no medical care or physical therapy services are being provided, these sessions do not fall under the protections of state or federal health privacy laws, such as HIPAA.
Recording and Use of Group Sessions
We may record group sessions for use on our website, social media platforms, promotional materials, or internal training. If you do not wish to appear in such recordings, you are responsible for turning off or blocking your webcam before the session begins.
By leaving your camera on, you are providing consent to be recorded and granting The Pelvister the right to use your image or likeness in recordings for any lawful purpose, including marketing and training, without expectation of credit, attribution, or financial compensation.
We will not identify you by name in any published recording unless you have given explicit permission—unless, of course, you voluntarily state your name during the session, in which case that information may be part of the recording.
- Eligibility
You must be at least 18 years of age to use this site or participate in our classes. We do not intend for our program(s) to be used by individuals younger than 18. By registering or purchasing a class, you confirm that you meet this age requirement and have received appropriate medical clearance, if necessary.
- User Responsibilities and Conduct
By using our services, you agree to:
- Participate responsibly and within your physical limits.
- Refrain from disruptive, offensive, or harmful behavior in live group sessions.
- Not record, reproduce, or share any portion of the class content without prior written permission.
We reserve the right to remove or block access to any participant who violates these rules, without refund.
- Intellectual Property
All content on this website—including but not limited to text, video recordings, class materials, graphics, branding, and logos—is the property of The Pelvister and protected by intellectual property laws. Unauthorized use, duplication, or distribution is strictly prohibited.
- Payments and Refunds
All payments made for classes are final and non-refundable unless otherwise stated. If a client is unable to attend a class they have registered for, no refund will be issued. However, the client will remain registered and may attend the same class at any future date of their choosing. There is no expiration date on the registration.
Rescheduling is allowed at no additional cost, provided space is available in the chosen session. Clients are encouraged to contact us in advance to arrange rescheduling.
We are not responsible for technical issues, including but not limited to internet connectivity problems, device malfunctions, or platform access issues on the client’s end. In the rare event of a technical issue on our end that prevents class delivery, we will offer rescheduling or an alternative solution.

- Modifications to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Changes will be posted on this page and will become effective immediately. Your continued use of the website and services after changes are posted constitutes your acceptance of the revised Terms.
- Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Kentucky, without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved in the appropriate courts of Kentucky.
- Technology Disclaimer
By participating in our online programs, you acknowledge and accept the inherent risks associated with technology. These may include, but are not limited to:
- Interrupted or unstable audio/video connections
- Temporary or permanent disconnection during live sessions
- Poor video or sound quality
- Unauthorized access to live or recorded content
While we make reasonable efforts to ensure a smooth and secure experience, The Pelvister is not responsible for any technological issues or failures that may occur during your participation in our programs.
- Liability Waiver and Release
By participating in any program offered by The Pelvister, you agree—on behalf of yourself, your heirs, assigns, personal representatives, and next of kin—to voluntarily assume all risks of injury, loss, or damage, whether foreseen or unforeseen.
You further agree to release, waive, and hold harmless The Pelvister, its owner, affiliates, officers, employees, contractors, agents, assigns, and any other associated individuals or entities (collectively, “Releasees”) from any and all claims, demands, causes of action, damages, losses, or expenses—including reasonable attorney’s fees—arising from personal injury, property damage, disability, or death that may occur in connection with your participation.
This release applies regardless of whether such injury or loss is caused by the negligence of the Releasees or otherwise, to the fullest extent permitted by law.
